Rapper Takeoff has a civil lawsuit against him after he was accused of rape at a house party. The civil suit was filed Wednesday in Los Angeles.
The alleged rape happened June 22 at a house party in Encino, California. Takeoff, whose real name is Kirshnik Khari Ball attended the party with Migos’ DJ Durel (Daryl McPherson).
According to the lawsuit, the victim who has not been identified claims that she went to the party to meet up with DJ Durel after being in constant contact on social media.
The victim alleges that Takeoff made many sexual advances towards her making her feel “uncomfortable”. She reportedly told DJ Durel that she had “no desire to engage in any sort of intimate relationship with Takeoff”. DJ Durel offered to take her upstairs to his room, she claims.
On the way upstairs, the victim alleges that Takeoff and DJ Durel got into a verbal confrontation on the stairs. Once she got upstairs she claims that Takeoff entered the room.
Plantiff clearly and unequivocally refused Defendant Takeoff’s advances and stated to Defendant Takeoff that she did not want to have sex with him, the lawsuit claims.
The victim alleges that upon entering the room Takeoff grabbed her and flipped her face down and pulled down her clothes and began to rape her from behind. After he was finished he allegedly immediately left the room leaving the victim in shock.
The lawsuit continued..
Plantiff sought medical care at a nearby hospital that same day, where hospital staff observed physical evidence of forceful rape and notified the Los Angeles Police Department of the same.
LAPD has confirmed with the New York Times that they have opened an investigation into the incident. The victim’s lawyer Neama Rahmani said he has already “lost confidence” in the investigation and thus filed the civil lawsuit ahead of any potential charges.
We hope that the media attention will motivate the Los Angeles Police Department to pursue the criminal investigation more aggressively, Rahmani said.
Justice delayed is justice denied, and continues to victimize a woman who has already been victimized by the rich and famous, he continued.
The civil lawsuit is accusing Takeoff of sexual battery, assault, false imprisonment, inflicting emotional distress, gender violence, and a pair of civil rights violations.
We have reviewed the allegations and have similarly done our own due diigence. What has become abundantly clear is that the allegations made against Mr. Ball are patently and provably false, Takeoff lawyer says in a statement.
The claims and statements made regarding this lawsuit indicate that the plantiffs’ representatives have not spoken with relevant witnesses or reviewed available evidence. Mr.Ball is renowed for his artistic talent as well as his quiet, reserved and peaceful personality. In this instance, those known personality traits have made him a target of an obvious, exploitative money grab. As his counsel, we are well aware and well versed on the importance of civil and criminal prosecution of true sexual assaults. This is not one of those situations.
There have been no charges filed at this time. We will continue to update this story as updates become available.
