Judge Emmet Sullivan of the federal district court in D.C. issued a preliminary injunction that ordered the Trump administration to halt the practice of deporting unaccompanied minors under a class-action lawsuit against the Department of Homeland Security (DHS). The plaintiff is a 16-year-old boy from Guatemala. He was designated for deportation after entering the country in August, unaccompanied by an adult.

The Trump administration has deported close to 9,000 unaccompanied minors since March. They issued an emergency declaration citing the coronavirus pandemic as the reason for not allowing the children to stay in the United States.

Lee Gelernt, the plaintiff’s lawyer from the American Civil Liberties Union said,

This policy was sending thousands of young children back to danger without any hearing.Today’s ruling is a critical step in halting the Trump administration’s unprecedented and illegal attempt to expel children under the thin guise of public health.
